By accessing and using PropGo.my ("Service"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") apply to all users of the service, including property seekers and real estate agents.
2. Description of Service
PropGo.my is a Malaysian property marketplace platform that connects property seekers with real estate agents through "Want To Buy" (WTB) and "Want To Rent" (WTR) requests.
For Property Seekers:
- Post unlimited WTB/WTR property requests
- Receive responses from verified agents
- Communicate directly with agents
- Access to basic platform features
For Real Estate Agents:
- Free Tier: Respond to 10 property requests per month
- Pro Tier (RM 199/month): Unlimited responses, verified badge, premium features
3. User Accounts and Registration
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your account information
- Keep your account credentials secure
- Notify us immediately of any unauthorized use
4. Subscription and Payment Terms
Agent Subscriptions:
- Free Tier: No charge, 10 responses per month limit
- Pro Tier: RM 199/month, unlimited responses
- Payments are processed securely through Stripe
- Subscriptions auto-renew monthly unless cancelled
- Usage resets monthly on your billing date
Cancellation:
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
5. Acceptable Use
You agree not to:
- Post false, misleading, or fraudulent property information
- Impersonate others or provide false identity information
- Engage in spam or unsolicited communications
- Violate any applicable laws or regulations
- Circumvent usage limits or restrictions
- Use automated tools to access the platform
6. Agent Verification
Real estate agents may be required to provide:
- Valid REN (Real Estate Negotiator) license number
- Professional credentials and documentation
- Agency affiliation details
Verified agents receive a verification badge and enhanced profile features.
7. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information in compliance with Malaysian Personal Data Protection Act (PDPA) 2010.
8. Intellectual Property
The Service and its content are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
9. Platform Role and Disclaimers
IMPORTANT DISCLAIMER: PropGo.my is an intermediary platform only. We are NOT responsible for any property transactions, listings, offers, or user-generated content.
Platform Role:
PropGo.my acts solely as an intermediary platform connecting property seekers with real estate agents. We provide technology infrastructure and facilitate communication but are NOT a party to any transactions.
What We Do NOT Do:
- Guarantee the accuracy, completeness, or authenticity of any property information
- Endorse, verify, or recommend any particular agent, agency, or property
- Act as a party to any property transactions, negotiations, or agreements
- Provide legal, financial, or real estate advice
- Conduct property inspections, valuations, or due diligence
- Handle escrow, payments, or transaction processing
- Ensure compliance with property laws, regulations, or permits
- Verify agent credentials, licenses, or professional standing
User-Generated Content Disclaimer:
ALL content posted by users (property requests, responses, listings, offers, communications) is the sole responsibility of the posting user. PropGo.my:
- Does not pre-screen, verify, or endorse user-generated content
- Is not responsible for the accuracy, legality, or authenticity of any content
- Does not guarantee that content complies with applicable laws or regulations
- Reserves the right to remove content that violates our terms or Malaysian law
- May cooperate with authorities regarding illegal content as required by law
10. Limitation of Liability
LIMITATION OF LIABILITY: To the maximum extent permitted by Malaysian law, PropGo.my's liability is strictly limited as set forth below.
General Limitation:
IN NO EVENT SHALL PROPGO.MY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Property transaction failures, disputes, or losses
- Fraud, misrepresentation, or illegal activities by users
- Inaccurate, incomplete, or misleading property information
- Agent misconduct, negligence, or professional malpractice
- Property defects, legal issues, or regulatory violations
- Financial losses from property investments or transactions
- Personal injury or property damage arising from property visits
- Service interruptions, downtime, or technical failures
- Third-party actions, content, or services
Maximum Liability Cap:
PROPGO.MY'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO PROPGO.MY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR RM 1,000, WHICHEVER IS GREATER.
Exclusions:
These limitations do not apply to:
- Gross negligence or willful misconduct by PropGo.my
- Death or personal injury caused by PropGo.my's negligence
- Fraud or fraudulent misrepresentation by PropGo.my
- Liability that cannot be excluded under Malaysian law
11. User Responsibilities and Indemnification
Your Responsibilities:
By using our platform, you agree to:
- Verify all property information independently before making decisions
- Conduct your own due diligence on properties and agents
- Obtain professional advice (legal, financial, real estate) as needed
- Comply with all applicable Malaysian laws and regulations
- Use the platform only for lawful purposes
- Not rely solely on platform information for important decisions
- Report suspicious or illegal activities immediately
Indemnification:
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS PROPGO.MY AND ITS AFFILIATES FROM ANY CLAIMS, DAMAGES, LOSSES, LIABILITIES, AND EXPENSES (INCLUDING REASONABLE ATTORNEY FEES) ARISING FROM:
- Your use of the platform or violation of these terms
- Your property transactions or interactions with other users
- Your violation of any laws or third-party rights
- Your user-generated content or communications
- Your negligence or misconduct
12. Content Moderation and Prohibited Activities
Prohibited Content and Activities:
You agree NOT to use the platform for any of the following prohibited activities:
- Posting false, misleading, or fraudulent property information
- Impersonating others or providing false identity information
- Posting content that violates Malaysian laws (CMA, Online Safety Act 2024)
- Harassment, threats, or cyberbullying of other users
- Spam, unsolicited communications, or commercial solicitation
- Content sensitive to race, religion, or royalty
- Child sexual abuse material or content harmful to minors
- Financial fraud, scams, or deceptive practices
- Intellectual property infringement
- Circumventing usage limits or platform restrictions
- Using automated tools to access or scrape the platform
- Any activity that could damage the platform's reputation
Content Moderation:
PropGo.my reserves the right to:
- Monitor, review, and remove any content that violates these terms
- Suspend or terminate accounts that engage in prohibited activities
- Cooperate with Malaysian authorities regarding illegal content
- Implement automated content filtering and moderation tools
- Take legal action against users who violate these terms
13. Account Termination and Suspension
Termination by You:
You may terminate your account at any time by contacting us at support@propgo.my. Upon termination:
- Your access to the platform will be suspended
- Your user-generated content may be deleted
- Active subscriptions will be cancelled
- Data will be retained as required by law or these terms
Termination by Us:
We may suspend or terminate your account immediately if you:
- Violate these Terms of Service or our policies
- Engage in illegal activities or fraud
- Provide false information or impersonate others
- Fail to pay subscription fees (for Pro tier users)
- Create multiple accounts to circumvent restrictions
- Pose a risk to other users or the platform
14. Force Majeure and Service Availability
PropGo.my shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, acts of God, or extreme weather
- Government actions, regulations, or restrictions
- Internet outages, cyber attacks, or technical failures
- Third-party service provider failures
- Labor disputes, strikes, or work stoppages
- War, terrorism, or civil unrest
Service Availability: While we strive to maintain 99% uptime, we do not guarantee uninterrupted service availability and are not liable for any downtime or service interruptions.
15. Dispute Resolution
Informal Resolution:
Before pursuing legal action, you agree to attempt informal resolution by contacting us at support@propgo.my and allowing 30 days for response and resolution.
Binding Arbitration:
Any disputes arising from these terms or your use of the platform shall be resolved through binding arbitration in Malaysia under the Arbitration Act 2005, except for:
- Intellectual property disputes
- Disputes involving amounts less than RM 10,000
- Disputes requiring injunctive or equitable relief
Class Action Waiver:
You agree to resolve disputes individually and waive any right to participate in class actions or collective proceedings.
16. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with Malaysian law, including:
- Contracts Act 1950
- Consumer Protection Act 1999
- Personal Data Protection Act 2010
- Communications and Multimedia Act 1998
- Online Safety Act 2024
Any legal proceedings shall be conducted in the courts of Malaysia, and you consent to the exclusive jurisdiction of Malaysian courts for any disputes.
17. Changes to Terms
We may update these Terms periodically to reflect changes in our services, legal requirements, or business practices. We will notify users of significant changes through:
- Email notifications to registered users
- Platform notifications and announcements
- Updated terms posted on our website
- In-app notifications for mobile users
Acceptance: Your continued use of the platform after changes are posted constitutes acceptance of the updated terms. If you disagree with changes, you must stop using the platform and terminate your account.
18. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and PropGo.my regarding your use of the platform.
