1. Property Marketplace Specific Terms

PLATFORM DISCLAIMER: PropGo.my is a technology platform that facilitates connections between property seekers and real estate agents. We are NOT involved in property transactions.

Platform Role and Limitations:

  • Intermediary Only: PropGo.my acts solely as an intermediary platform providing technology infrastructure
  • No Transaction Involvement: We are not a party to any property transactions, negotiations, or agreements
  • No Property Endorsement: We do not endorse, verify, or recommend any properties, agents, or agencies
  • No Professional Services: We do not provide real estate, legal, financial, or valuation services
  • No Transaction Processing: We do not handle payments, escrow, or transaction processing

User-Generated Content Responsibility:

ALL content posted by users (property requests, responses, listings, offers, photos, descriptions, communications) is the sole responsibility of the posting user. PropGo.my:

  • Does not pre-screen, verify, or validate any user-generated content
  • Is not responsible for the accuracy, completeness, or authenticity of any property information
  • Does not guarantee that properties exist, are available, or match descriptions
  • Does not verify agent credentials, licenses, or professional standing
  • Does not ensure compliance with property laws, regulations, or permits

2. Property Transaction Disclaimers

TRANSACTION DISCLAIMER: PropGo.my is NOT responsible for any property transactions, losses, damages, or disputes arising from user interactions on our platform.

Property Information Disclaimers:

  • No Accuracy Guarantee: We do not guarantee the accuracy of any property information, photos, or descriptions
  • No Availability Confirmation: We do not confirm that properties are available for sale or rent
  • No Price Verification: We do not verify property prices, valuations, or market values
  • No Legal Status Check: We do not verify property titles, ownership, or legal status
  • No Condition Assessment: We do not inspect properties or assess their condition

Agent and Agency Disclaimers:

  • No Agent Verification: We do not verify agent credentials, licenses, or professional standing
  • No Agency Endorsement: We do not endorse or recommend any real estate agencies
  • No Professional Standards: We do not monitor or enforce professional standards
  • No Misconduct Liability: We are not responsible for agent misconduct, negligence, or malpractice
  • No Commission Handling: We do not handle or guarantee commission payments

3. User Responsibilities and Due Diligence

Property Seekers Must:

  • Conduct independent verification of all property information
  • Visit properties in person before making any commitments
  • Obtain professional inspections and valuations
  • Verify property titles, ownership, and legal status
  • Check compliance with local laws, regulations, and permits
  • Obtain legal and financial advice before transactions
  • Verify agent credentials and licenses independently
  • Not rely solely on platform information for important decisions

Real Estate Agents Must:

  • Maintain valid professional licenses and credentials
  • Provide accurate and truthful property information
  • Comply with all applicable real estate laws and regulations
  • Disclose any conflicts of interest or material information
  • Maintain professional standards and ethical conduct
  • Not engage in fraudulent or misleading practices
  • Obtain proper authorization to list properties
  • Handle client funds and transactions in accordance with law

4. Comprehensive Liability Limitations

MAXIMUM LIABILITY LIMITATION: PropGo.my's total liability is strictly limited to the amount paid by the user in the 12 months preceding any claim, or RM 1,000, whichever is greater.

Property-Related Exclusions:

PropGo.my is NOT liable for any losses, damages, or claims arising from:

  • Property transaction failures, disputes, or losses
  • Fraud, misrepresentation, or illegal activities by users
  • Inaccurate, incomplete, or misleading property information
  • Property defects, legal issues, or regulatory violations
  • Agent misconduct, negligence, or professional malpractice
  • Financial losses from property investments or transactions
  • Personal injury or property damage during property visits
  • Breach of contract between users
  • Disputes over commissions, fees, or payments
  • Property valuation errors or market fluctuations
  • Title disputes, ownership claims, or legal complications
  • Environmental issues, zoning violations, or permit problems

Platform Service Exclusions:

  • Service interruptions, downtime, or technical failures
  • Data loss, corruption, or security breaches
  • Third-party service provider failures
  • Inaccurate search results or matching algorithms
  • Communication failures between users
  • Content moderation decisions or delays
  • Account suspension or termination

5. Malaysian Legal Compliance

Compliance with Malaysian Laws:

These Terms and Conditions are designed to comply with Malaysian laws including:

  • Contracts Act 1950
  • Consumer Protection Act 1999
  • Personal Data Protection Act 2010 (PDPA)
  • Communications and Multimedia Act 1998
  • Online Safety Act 2024
  • Consumer Protection (Electronic Trade Transaction) Regulations 2024
  • Real Estate (Negotiation) Act 1981
  • Housing Development (Control and Licensing) Act 1966

Real Estate Industry Compliance:

  • Agents must comply with BOVAEA (Board of Valuers, Appraisers, Estate Agents and Property Managers) requirements
  • Property listings must comply with housing development regulations
  • All transactions must comply with Malaysian property transfer laws
  • Foreign ownership restrictions must be observed
  • Stamp duty and tax obligations must be fulfilled

6. Content Moderation and Safety

Prohibited Content:

Users are strictly prohibited from posting content that:

  • Violates Malaysian laws (CMA, Online Safety Act 2024)
  • Contains false, misleading, or fraudulent property information
  • Promotes illegal activities or scams
  • Is sensitive to race, religion, or royalty
  • Contains child sexual abuse material
  • Involves harassment, threats, or cyberbullying
  • Infringes intellectual property rights
  • Promotes spam or unsolicited communications

Content Moderation Rights:

  • PropGo.my reserves the right to monitor, review, and remove any content
  • We may suspend or terminate accounts for policy violations
  • We cooperate with Malaysian authorities regarding illegal content
  • We implement automated content filtering and moderation tools
  • We may take legal action against users who violate these terms

7. Dispute Resolution and Arbitration

Mandatory Arbitration:

Any disputes arising from these terms or platform use shall be resolved through binding arbitration in Malaysia under the Arbitration Act 2005, except for:

  • Intellectual property disputes
  • Disputes involving amounts less than RM 10,000
  • Disputes requiring injunctive or equitable relief
  • Criminal matters or regulatory violations

Class Action Waiver:

Users agree to resolve disputes individually and waive any right to participate in class actions or collective proceedings against PropGo.my.

8. Force Majeure and Service Availability

PropGo.my shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, acts of God, or extreme weather
  • Government actions, regulations, or restrictions
  • Internet outages, cyber attacks, or technical failures
  • Third-party service provider failures
  • Labor disputes, strikes, or work stoppages
  • War, terrorism, or civil unrest
  • Pandemic-related restrictions or health emergencies

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by Malaysian law. Any legal proceedings shall be conducted in the courts of Malaysia, and users consent to the exclusive jurisdiction of Malaysian courts for any disputes.
