Legal fees are one of the biggest of those side costs, and unlike your loan, you can't borrow them. When you buy a property with a bank loan, you're really signing two sets of documents, and each one needs a lawyer:

  1. The Sale and Purchase Agreement (SPA), which transfers the property to you.

  2. The loan (facility) agreement, which secures the bank's loan against the property.

The lawyer's professional fee for preparing and handling each of these is what people mean by "legal fees". It is a separate cost from stamp duty, which is a government tax, and separate again from disbursements, which are the small out-of-pocket items the lawyer pays on your behalf.

A quick way to remember it: stamp duty goes to the government, legal fees go to the lawyer, disbursements are the lawyer's petty cash. You pay all three upfront.

Property legal fees in Malaysia aren't random. They follow a fixed scale set by the Solicitors' Remuneration Order 2023, so every firm charges the same base rate. The scale is tiered, and the same tiers apply to both the SPA and the loan agreement (each calculated on its own amount, the property price for the SPA and the loan sum for the facility agreement):

Don't forget SST and disbursements

Two things sit on top of the scale fee, and they're the reason a "1.25%" estimate in your head always comes out low:

  • Service tax (SST) of 8% applies to the lawyer's professional fees. On a five-figure legal bill, that's a few hundred ringgit you need to account for.

  • Disbursements cover land searches, bankruptcy searches, registration fees, and similar items. These are usually a few hundred ringgit in total, but they're real cash on completion day.

A worked example

Say you're buying a RM500,000 home with a 90% loan (RM450,000):

  • SPA legal fees: 1.25% of RM500,000, which is RM6,250.

  • Loan agreement legal fees: 1.25% of RM450,000, which is RM5,625.

  • Subtotal: RM11,875.

  • SST at 8%: about RM950.

  • Legal fees total (before disbursements): roughly RM12,825.

Add a few hundred ringgit of disbursements and you're close to RM13,000 in legal costs alone, on top of your deposit and stamp duty. That's exactly the kind of figure you want to see before you commit, not after.
